Isang mapagpalang araw po sa inyo, Sir!

Ako po ay isang maybahay. Nakatira po ako sa isang pribadong subdivision. Ang bahay at lupa po na aking tinitirahan at ng aking anak sa ngayon ay nabili namin ng installment sa isang developer dito po sa Metro Manila. Ang monthly amortization payment po ay nanggagaling sa pinaghirapan ng aking asawa bilang isang seaman sa international vessel. Halos limang taon po naming nahulugan ang aming bahay at lupa. At sa wakas po ay nakapagbayad kami ng full noon pa pong year 2000.

Alam po ninyo, Atty., lagi po akong pabalik-balik sa opisina ng developer upang kumuha ng titulo ng aming lupa at bahay na nabili. Puro pangako po sila simula pa noong year 2000 hanggang ngayon po.

Hanggang ngayon po ay wala pang titulo na naiibigay sa amin sa kabila ng pagde-demand naming mag-asawa ng titulo sa aming bahay at lupa na nabili.

Nagsampa na po ako ng reklamo sa HLURB against sa developer na ito.

May kaso po bang criminal ang hindi pagre-release ng developer ng titulo despite the fact na bayad na po ng kumpleto ang bahay at lupa?

Opo, maaari ninyong kasuhan ng violation of Presidential Decree No. 957, as amended by Presidential Decree No. 1344, ang subdivision developer. This is clarified in the recently issued Department Order 27 dated July 25, 2007 of the Department of Justice, particularly Section 1 of said Department Circular.

Section 1, Department Circular No. 27 provides that “criminal complaints for violations of PD 957 as amended by PD 1344 may be filed directly with the Office of the Provincial or City Prosecutor of the place where the subdivisions, condominiums, housing projects or developments are located.”

So, maaari mong i-file directly ang criminal case for Violation of Presidential Decree No. 957, as amended by Presidential Decree No. 1344, against the subdivision developer sa lugar kung saan naroon ang bahay at lupang nabili mo mula sa developer.

Sa isang banda naman, maaari kang magsampa ng civil case against the developer at ito ay maaari mong isampa sa HLURB. Ang kaso na naisampa mo rito ay gagabayan ng Rules of Procedure ng HLURB.

Nais ko ring ipabatid sa iyo kung sakali na nauna mo nang isampa ang civil case sa HLURB, ang HLURB sa ilalim ng nasabing Department Order 27 dated July 25, 2007 of the Department of Justice, through the Task Force Subdivision and Condominium, may refer to the appropriate Office of Provincial or City Prosecutor, for preliminary investigation criminal cases arising from violations of PD 957 and amended by PD 1344.

Whether the criminal cases are directly filed or through the HLURB Task Force, the preliminary investigation shall be conducted in accordance with the Revised Rules of Criminal Procedure and when warranted, the proper information shall be filed in court.

Ang hindi pagsunod sa PD 957, as amended by PD 1344, ng isang developer, katulad ng hindi pagre-release ng titulo sa nabiling house and lot, ay isang criminal case na po.

Kaya nananawagan kami sa mga biktima ng mga kumag na developer, sumulat po kayo sa amin at handa namin kayong tulungan laban sa mga ito sa panloloko nila. Sa mga susunod na column natin, ibibigay po namin ang mga salaysay ng mga kliente natin lalo na ’yung mga OFW nasa Hong Kong at Singapore.
